Terms of Business
This document sets out the terms of business between Performance Finance Ltd and its clients.
We are regulated by the Financial Conduct Authority (FCA) and follow their guidance in terms of procedures, treating customers fairly and complaints.
Scope of our business
Performance Finance Ltd is a fully FCA authorised direct lender and credit broker.
We provide Lease, Loan and Hire Purchase facilities via regulated and non-regulated agreements.
These can be made available via our own funds or via our network of approved lenders.
Charges for our services and commissions received
For agreements we arrange through third parties:
- You will not be charged directly for the provision of finance agreements.
- We reserve the right to charge for additional services you request post-activation (e.g. settlement figures).
- Any such charges will be fair and reasonable.
Performance Finance Ltd does not charge a fee for arranging your finances. We can introduce you to a limited number of carefully selected credit providers.
Our role as a credit broker is to determine which lender on our panel is most suitable for your needs and circumstances.
Each credit provider may have different interest rates and charges. We will receive commission from the credit provider for introducing you to them; the commission received is either a fixed fee or a percentage of the amount you borrow.
Although they pay commission, this does not affect the amount that you pay to that lender under your credit agreement.
Should you wish to know how much commission we will receive, please contact the Compliance Officer.
For agreements where we are a direct lender:
- There will be no additional fees for our services other than those clearly stated in your agreement.
- We reserve the right to charge for additional services you request after activation.
Introductions
We may agree to pay commission, referral, or introduction fees to a supplier, intermediary, or third party for introducing business opportunities. If any introductory fee is payable, we will confirm this in writing to you along with the amount due, within the finance documentation pack for your signature.
You are also welcome to ask if a fee is payable at any point during our discussions/negotiations.
Insurance
We do not advise or arrange insurance products.
Advice and Recommendations
Any advice your account manager provides will be based on your personal or business financial disclosures. It is important to answer questions fully and accurately so that we can best assess your needs and requirements. There is no obligation to take out finance with Performance Finance and other methods of financing may be available to you.
Your Duty of Disclosure
You must provide complete and accurate information when applying for credit.
Failure to disclose relevant information or changes in circumstances may lead to withdrawal of credit approval.
Acting in your Best Interests
If any material interest or conflict of interest should arise in business that we are arranging for you, we will let you know and ask for your consent before we carry out your instructions.
Consumer Duty
We are committed to delivering good outcomes for all our customers, in line with the FCA’s Consumer Duty. This means:
- Acting in your best interests at all times.
- Ensuring products and services offer fair value.
- Providing clear, timely and understandable information.
- Supporting customers, including those in vulnerable circumstances.
- Handling complaints promptly and fairly.
Your Rights
The FCA has rules which affect the rights you have as a customer.
Withdrawal rights: For regulated consumer credit agreements, you have a legal right to withdraw within 14 days of signing your agreement, without giving a reason. Full details of how to exercise this right will be provided in your credit agreement and pre-contractual documentation.

General Data Protection Regulation (GDPR) 2018
The personal data you provide will be used and stored under the General Data Protection Regulation (GDPR) 2018. You have a right to access all the personal information that Performance Finance Ltd holds about yourself. Read our full Privacy Policy. Performance Finance Ltd holds the government-backed Cyber Essentials Accreditation. In addition to the standard GDPR policies, it is important to also understand what technology is in place to handle data, long term throughout any finance agreement. Data can be provided, safely and securely to Performance Finance Ltd.
Our organisation is protected from 80% of common cyber threats. Personal information is processed under strict procedures in line with the cyber essential requirements.

Governing Law
This agreement is governed by the laws of England and Wales, subject to the jurisdiction of the English courts.
Financial Crime
All transactions relating to the services provided by us are covered by Money Laundering Regulations and the Proceeds of Crime Act. The FCA also requires that we have appropriate measures in place to prevent fraud, money laundering and other financial crime. Our responsibilities under these Regulations, and the rules of the FCA, include but are not limited to verifying the identity and address of our clients and any third party making payments on their behalf. Where we require, you must supply proof of your identity under the requirements of the above Regulations. We reserve the right to carry out electronic identification and anti-money laundering checks on all Directors and/or beneficial owners owning 25% or
more of the voting share capital of the business.
Financial Searches
Electronic searches of the electoral roll and the use of credit reference agencies will result in a 'footprint' on your credit records. This footprint is visible to other financial service providers and may affect your credit rating. We will only action searches if you agree to proceed with a credit approval process with us.

On occasions that we feel it is appropriate for us to charge a fee for additional services, you request, post-completion, we promise that it will be reasonable and justifiable.
All our staff will be professional and courteous to you – even if they are not directly involved in your business.
If you are unhappy with the service we provide we will take your complaint seriously and attempt to resolve the matter to your complete satisfaction.
